What does this Privacy Policy cover?

We are The Gambit Foundry LLC (“The Gambit Foundry”, “we”, or “us”). 

This Privacy Policy applies to our video game software (including the “Riftblade” game) and associated websites (together, we’ll refer to these as the “Service”).

What Information Do We Collect?

We collect and process different types of personal data depending on how you interact with our Service. Here’s an overview of the information we collect:

Contact Information

When you interact with us (such as when you provide feedback or report issues, you request or receive customer or technical support, and you sign up for communications (newsletters, updates, promotions)), we collect certain contact information such as your name and email address, and anything that you include in your communications with us.

Account and Profile Information

When you create or update an account with us (or connect a third-party account to the Service), we collect certain information to manage your account, including your email address, name, password, username, and other information provided to us by the connected third-party account. We also associate gameplay progress and other data to your account.

We use this information to create and manage your user account, enable account features (recovery, personalization, preferences), enable multiplayer and cloud save/syncing features, enforce platform rules and security measures, and track purchases related to your account.

Device and Behavior Information

We automatically collect certain technical and analytic information from you and your device when you use our Service, including your device specifications (device type, model, OS, browser), your IP address, performance metrics (crashes, errors, load times), and system information (such as game performance data).

We use this information to analyze user behavior and preferences, ensure Service compatibility and performance, improve design and user experience, and troubleshoot any technical issues you encounter on the Service.

Transaction Information

When you make purchases or engage in other transactions through our Service, we collect certain payment and transaction information, including your billing and shipping addresses, payment method (last 4 digits only), phone number, and purchase history and associated IDs. Please note that we do not store complete payment card information - this is handled by our secure payment processors.

We use this information to process transactions and subscriptions, maintain purchase records, manage refunds and disputes, and to prevent fraudulent activity.

Advertising Information

When you use the Service, we may collect certain information for targeted advertising purposes, including your device advertising identifiers, ad targeting and attribution data, and interest categories.

We use this information to display relevant promotions, optimize ad targeting, and track campaign effectiveness.

How Do We Share Your Information?

  • Technical Service Providers: We may share certain personal data with trusted service providers who help us operate and improve our Service, to host our services and store your data securely, manage user authentication, and manage our email and marketing communications.

  • Platform Partners: We share data with third-party platform partners to enable cross-platform and multiplayer gameplay, manage player achievements, process in-game purchases, and sync game progress and saves.

  • Payment Processors: We share data with our third-party payment processor partners to process payments and transactions, prevent fraudulent transactions, and process refunds.

  • Advertising Partners: We share data with third-party advertising providers to enable relevant advertisements, measure ad performance, prevent ad fraud, and track campaign effectiveness.

How long do we keep your data?

We only keep your personal data as long as it’s required to provide you with the Service. Sometimes a longer period might be required by law. After that, we will delete your personal data within a reasonable time.

Please note that we may retain some data, if necessary to resolve disputes, enforce our user agreements, or to follow any technical and legal requirements related to the Service.

Children’s privacy rights

We don’t knowingly collect any personal data from children under the age of 13. We also don’t knowingly allow them to create accounts, sign up for newsletters, make purchases, or use the Service. Cookies, Advertising, “Do Not Track” Signals

“Do Not Track” Signals: Because there’s not yet a consensus on how companies should respond to web browser-based or other “do not track” mechanisms yet, we do not respond to web browser-based do not track signals.

Remarketing: We use remarketing ads, to advertise to certain previous visitors to the Service, often who have not completed a task or have otherwise shown interest in the Service before leaving. These advertisements will show up on third-party websites.

If you would like to opt-out of remarketing collection on the Service, you may use the Network Advertising Initiative’s tools to opt out of interest-based advertising by participating companies. 

If you are using a mobile device, you can access the device’s settings to control the use of device identifiers, as well.

We believe in giving users control over their personal data. This section outlines your rights (some of which may be based on where you reside) and how to exercise them.

All Users:

Regardless of your location, you have the right to:

EU and UK Residents:

We are regulated under the General Data Protection Regulation (GDPR), which applies across the European Union. For UK residents, you have similar rights under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We are responsible as a controller of personal data for GDPR and UK GDPR purposes.

Legal Basis for processing your personal data:

In accordance with the General Data Protection Regulation (GDPR) and UK data protection law, we process your personal data based on the following legal grounds:

  • Consent. For personal data collected when you provide it to us directly, we may rely on your explicit consent. In these situations, you have the right to withdraw your consent at any time (see “How to Contact Us” below). Additionally, we rely on your consent to implement interest-based advertising on certain platforms. In those cases, you may withdraw your consent through your device’s settings.

  • Contractual Obligations. We process specific sets of your data to fulfill our contractual obligations to you. This encompasses actions like account creation and management, handling purchases, and general Service operations.

California Resident Rights

Canadian Residents:

Brazilian Residents:

We are regulated under the Lei Geral de Proteção de Dados (“LGPD”), which applies to Brazilian residents. 

Under the LGPD, Brazilian residents have several important rights:

  • Access your personal data, correct any errors, or delete your personal data

  • Anonymize, block, or delete data that we don’t need or are not processing in compliance with the LGPD

  • Request we transfer your data to another provider

  • To be informed about who we share your data with

These rights apply to any personal data collected or processed in Brazil, as well as any personal data processed for the purpose of providing goods or services in Brazil.

International Data Transfers

Our headquarters is in the United States. No matter where you live, by using the Service you consent to the processing and transfer of your personal data in and to the United States. 

Security Measures

We have taken steps and put security measures in place to prevent the accidental loss or misuse of personal data. 

For example, we limit access to those who have a genuine business need. Those processing your information will do so only in an authorized manner. 

We use other security measures, as well, such as:

  • Encryption at rest and in transit

  • Role-based access controls and Multi-factor authentication

  • Firewalls and vulnerability scanning

We also have procedures in place to deal with any suspected data security breach. We’ll notify you and any applicable regulator of a suspected data security breach when legally required.
